ALPHAEON CREDIT, INC. TERMS AND CONDITIONS

These terms and conditions create a contract (the “Agreement”) between you and Alphaeon Credit, Inc (“ACI”). Please read the Agreement carefully. To confirm your understanding and acceptance of the Agreement, click “Agree.”

 A. INTRODUCTION TO OUR SERVICES

This Agreement governs your use of ACI’s services (“Services”), through which you can access credit programs offered by third parties. Our Services are available for use in the United States only. To use our Services, you will need to agree to these terms and conditions and meet certain requirements defined by ACI including being a board-certified dentist, dermatologist, ophthalmologist, or plastic surgeon and/or affiliated with one. 

B. USING OUR SERVICES

PAYMENTS AND REFUNDS

Upon enrollment acceptance by ACI and any third-party offering access to credit programs, you will be able to offer these credit programs to new and existing patients. Under this Agreement, you agree:

  • You will not submit transactions more than 30 days in advance of a surgery, procedure, or treatment and refunds will be made if other factors, in or outside of your control prevent you from proceeding with the surgery, procedure, or treatment.

  • You understand that ACI and third-party credit programs will not honor “no refund policies”. In the event services are not rendered for any reason, you must refund the patient immediately upon cancelation, excluding “hard costs” which may include:

    • Custom materials ordered specifically for the patient that cannot be repurposed;

    • Pre-booked surgical suites and anesthesia fees that cannot be refunded by the hospital, ASC, anesthesiologist or specialist;

    • Non-refundable deposit or reasonable cancellation fees; and 

    • Other reasonable charges for non-refundable expenses approved in advance, in writing, by ACI.

  • In the event of a charge dispute by a patient, you will provide signed receipts, ID documentation, and a copy of refund/cancellation policies to ACI and/or the third-party providing credit.

CONDITIONS OF PARTICIPATION

As a condition to your participation in the ALPHAEON CREDIT program and in consideration of the services provided to you by ACI, you agree to indemnify and hold harmless ACI and its affiliates, officers, directors, employees, subcontractors and their respective successors and assigns from any and all losses incurred by ACI that shall have been caused by or are related to (x) goods and/or services charged by you to any patient and/or (y) the damages, acts or omissions of you, your affiliates, officers, directors, employees, subcontractors, and their respective successors, and/or (z) any breach by you (or any of your affiliates, officers, directors, employees, subcontractors and their respective successors) of the operating procedures of any third party providing credit.

 These terms and conditions shall be governed by the laws of the State of California and any dispute between you and ACI shall be settled by binding arbitration in Los Angeles, California under the Rules of Comprehensive Arbitration before the Judicial Arbitration and Mediation Service (“JAMS”). The prevailing party shall be entitled to recover reasonable attorney’s fees and costs. 

TERMS MODIFICATION

We may modify these Terms from time to time in which case we will update the “Last Revised” date at the top of these Terms. If we make changes that are material, we will notify you by email and/or post. However, it is your sole responsibility to review these Terms from time to time to view any such changes at www.myalphaeoncredit.com/enroll. The updated Terms will be effective not less than 30 days after we provide notice to you; your continued use of the Program will be your consent to the revised Terms.
